He sued the Home Office to get it back and lost, at the High Court and the Court of Appeal. Threat level isn't the question; who pays is, and RAVEC already answered it. He's a wealthy private citizen with private security. William and Catherine do the job and get the protection tied to it. The public purse is not his security budget.
